Terms of use

These Terms of Use (“Terms”) govern your access to and use of the Jesse mobile application (“Jesse,” the “app,” or the “Service”), operated by Jesse (“we,” “us,” or “our”). Jesse is a trip-intelligence and co-piloting app built for owner-operators and long-haul drivers.

By creating an account or using Jesse, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1.Eligibility

You must be at least 18 years old and able to form a binding contract to use Jesse. By using the app, you represent that you meet these requirements and that any information you provide is accurate.

2.Your account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization. We are not liable for losses arising from unauthorized use of your account.

3.Safety and driver responsibility

Jesse is a driving aid that provides routing, traffic, weather, and trip information to support your planning and your trips. It is not a substitute for your own judgment, attention, or compliance with the law.

• –You are responsible for operating your vehicle safely and for obeying all traffic laws, posted signs, and regulations at all times. Do not interact with the app in any way that distracts you from driving, and follow all laws regarding device use while operating a vehicle.
• –Routing, traffic, weather, and arrival information may be inaccurate, incomplete, or delayed. Conditions change, data sources have limits, and you must not rely on Jesse as your sole source of truth. Always defer to actual road conditions, signage, and your own assessment.
• –You are responsible for confirming that any route is legal and appropriate for your specific vehicle, including its height, weight, length, axle configuration, cargo, and any hazardous-materials or other commercial restrictions. Jesse may not account for all such restrictions, and you must verify routes against posted limits and applicable regulations before and during travel.
• –In an emergency, contact local emergency services. Jesse is not an emergency service.

To the fullest extent permitted by law, we are not responsible for accidents, citations, delays, damages, or losses arising from your use of, or reliance on, information provided by the app.

4.The Jesse assistant

Jesse includes an AI-powered assistant that generates responses and guidance based on your messages and trip context. The assistant can make mistakes, may produce inaccurate or incomplete information, and does not provide professional, legal, regulatory, or safety advice. Treat its output as informational only and verify anything you intend to rely on.

5.Beta and pre-release versions

Jesse may be made available to you as a beta or pre-release version, including through TestFlight. Beta versions are provided for testing and may contain bugs, may behave unexpectedly, may change or be discontinued at any time, and may not represent the final product. We may collect feedback and diagnostic information from beta participants as described in our Privacy Policy.

6.License to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Jesse for your own use. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except where such restrictions are prohibited by law.

7.Acceptable use

You agree not to:

• –use the app for any unlawful purpose or in violation of these Terms;
• –interfere with, disrupt, or attempt to gain unauthorized access to the app, our systems, or other users’ accounts;
• –use automated means to access or scrape the app, or attempt to circumvent any security or rate-limiting measures;
• –upload or transmit malicious code, or content that is unlawful, infringing, or harmful; or
• –use the app in any way that could damage, disable, or impair the Service.

We may suspend or terminate your access if you violate these Terms.

8.Intellectual property

The app and its content — including the Jesse name, wordmark, mascot, design, software, and other materials — are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. Feedback you provide may be used by us without obligation or compensation to you.

9.Third-party services

Jesse relies on third-party services, including mapping, routing, traffic, weather, backend infrastructure, and AI providers, as well as the platform through which you obtained the app (such as the Apple App Store). Your use of those services may be subject to their own terms, and we are not responsible for third-party services or their content. Where the app is obtained through an app store, you also agree to that store’s applicable terms.

10.Disclaimers

To the fullest extent permitted by law, Jesse is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any information it provides will be accurate or reliable.

11.Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us to use the app in the twelve months before the claim, or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12.Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any law or the rights of a third party.

13.Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

14.Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the version and effective date above and notify you within the app. Where required, we will ask you to review and agree to the updated Terms before continuing to use Jesse.

15.Governing law

These Terms are governed by the laws of the State of [state], without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in [county, state], unless otherwise required by law. Before filing any claim, you agree to first contact us to attempt to resolve the matter informally.
